In essence, an 'independent contractor' is someone who is in business for themselves. We're sure you'll agree that business laws and standards such as licensing, permits & insurance, are absolutely necessary to protect consumers, employees and businesses alike.

  • A large percentage of delivery companies in Los Angeles, both large and small, classify their drivers as independent contractors to  avoid  workers' compensation insurance premiums and payroll taxes.  While consumers benefit from lower rates , they are also being put at  risk of liability.
  • How?   Aside from other qualifications, a majority of these drivers do not hold motor carrier permits to operate as an independent contractor, nor do they have the required insurance protections. 
  • The result?  Should the driver be involved in a major accident, the consumer the driver was working for at the time of the accident could well be sued by both the delivery driver and even an injured third party!   
  • Could this really happen?  A very common example is when an unlicensed and uninsured construction contractor is injured while working on a homeowners property and then sues the homeowner!  
  • Remember, even if a courier company has a valid motor carrier permit, workers' compensation and other required insurance, if they classify courier drivers as independent contractors, chances are they are not paying premiums on those drivers and hence they are not covered under those policies.
